How long does an SBR take to approve?
When a short-barreled rifle is registered with ATF, it goes on one of two forms — Form 1 if you build it from a rifle you already own, which is what most people do, or Form 4 if you buy one already built from a dealer. Here is what 4,396 community-reported approvals show for each path. Form 1 builds by individuals are currently running a median of about 1 days, and about 4 days for trusts. Not official ATF records — individual timelines vary.

ATF processes the application, not the item, so a Form 1 sits in the Form 1 queue whether it is an SBR or a suppressor — the form is what sets your wait. Why SBR waits are what they are
Nothing about the rifle sets the timeline — the ATF review does. Your wait depends on which form you filed, how you filed it, owner type, and how much work is already queued ahead of you. Form 1 is the relevant queue for most SBR builders, and it is the queue that absorbed the largest share of new filings after the making and transfer tax dropped to $0. Free stamps removed the cost barrier; they did not add examiners.

Most SBRs are built rather than bought, which means a Form 1 — and in community-reported data a Form 1 is currently running a national median of about 1 days. Buying a factory-built SBR from a dealer is a Form 4 transfer instead, running about 3 days. Why can a Form 1 SBR take longer than a Form 4 suppressor?
The two forms are processed as separate workstreams, so they move at their own speeds and the ordering can flip. After the making and transfer tax went to $0, Form 1 volume in particular climbed, and the backlog that built up through the first half of 2026 is what drove that year's long Form 1 waits, not anything about the rifle. The Form 1 · Individual median climbed to 69 days by Jun 2026 and has since come down to 1 in Oct 2026.
Does e-filing an SBR Form 1 go faster than paper?
E-filing is generally the faster route, and Form 1 builds are well suited to it. As more filers report their submission method we surface the split directly; check the estimator for the current figures.
Do I need a gun trust to build an SBR?
No — an SBR can be registered to you as an individual. A trust mainly changes who may legally possess the rifle and what happens to it when you die; it is an estate-planning decision, not a speed trick. For what it's worth, right now individuals are running quicker on Form 1 — about 1 days versus 4 for trusts. That gap moves around and is not a reason to pick one over the other.
Can I start building my SBR while the Form 1 is pending?
As of October 9, 2026, ATF says it no longer requires approval or registration before making a short-barreled rifle, so federally the Form 1 is now voluntary, and ATF says it will keep processing the ones that are filed. That is a federal enforcement policy, not a change to state law: ATF's letter notes that most states have criminal prohibitions on some or all NFA items, often with exceptions for items registered under federal law, so in some states an unregistered SBR can still be a crime. Taking an SBR across state lines still requires an approved Form 20. ATF also warns enforcement could resume, with no automatic grandfathering for unregistered items. Check your state first; nothing here is legal advice.
